Child Pornography & CSAM Defense in Hamilton Township

Defense Attorney Serving Mercer, Burlington, & Monmouth Counties

A child pornography or child sexual abuse material (CSAM) investigation can turn your life upside down before you have had an opportunity to understand what the State believes happened. A search of your home, seizure of a phone or computer, or request to speak with investigators can leave you with more questions than answers.

In Hamilton Township and throughout Mercer County, these investigations can involve online accounts, file-sharing activity, electronic devices, and digital forensic examinations. New Jersey State Police investigates technology-related crimes involving the exploitation of children and provides computer-forensic services to other law enforcement agencies.

At The Law Office of Zapicchi & Liller, LLP, we handle criminal defense matters with personal attention and a thorough review of the facts. If you are facing a New Jersey state child pornography or CSAM charge, we examine how the evidence was obtained, what it shows, and whether the State can prove the elements of the offense.

If investigators have contacted you or taken an electronic device, speak with our criminal defense attorney at (609) 400-4404 before trying to explain the situation yourself.

What a CSAM Investigation Can Involve

These investigations can develop from information about online activity, file-sharing, an internet connection, an online account, or suspected files uploaded from a particular location.

That concern is not hypothetical in Hamilton Township. In December 2025, Mercer County investigators reported an active CSAM investigation involving files uploaded to the internet from a local residence. Investigators obtained a search warrant for the home and seized digital evidence.

Depending on the circumstances, an investigation may involve:

  • Cell phones and tablets
  • Desktop or laptop computers
  • External hard drives or other storage devices
  • Online accounts and associated records
  • File-sharing applications
  • Internet and network information
  • Digital forensic examinations

When more than one person has access to a device, account, or internet connection, the circumstances can raise questions about who actually engaged in the conduct alleged by the State. Device history, account activity, timing, and other records may provide important context.

New Jersey Child Pornography & CSAM Charges

New Jersey addresses CSAM offenses under N.J.S.A. 2C:24-4 (Endangering the Welfare of a Child).

The statute covers distinct types of conduct, and the specific offense charged determines the elements the State must prove:

  • Possession or viewing. New Jersey law addresses knowingly possessing, viewing, or controlling covered material through any means, including the Internet. The degree can depend on the number of items involved, with separate thresholds for fewer than 1,000 items, 1,000 to 99,999 items, and 100,000 or more items.
  • Distribution and file-sharing. The statute addresses knowingly distributing covered material, possessing it with intent to distribute, and certain conduct involving file-sharing programs that make material available to other computers.

The exact charging language matters. We review the offense alleged and the evidence tied to it rather than treating every CSAM investigation as the same type of case.

Evaluating Digital "Possession" & Shared Files

Everyday use of the word “possession” does not necessarily capture how New Jersey's criminal statute addresses digital media.

Depending on the facts, relevant questions may include:

  • Who had access to the device or account?
  • Where was the material located?
  • What does the available forensic evidence show?
  • When did the relevant activity occur?
  • What evidence did investigators rely on to connect the activity to the accused?

These questions can help clarify what the digital evidence actually establishes.

What Happens to Your Phone or Computer After a Search?

When police seize a phone, computer, or hard drive, the device may be examined as part of the investigation. A forensic examination can involve files, system activity, applications, accounts, metadata, and other digital information relevant to the allegations.

Do not try to investigate the device or account yourself after a search. If officers have seized your electronics, do not delete files, reset devices, clear browser histories, move or forward suspected material, or alter related accounts.

A defense attorney can review the circumstances of the search and seizure, including the authority relied upon by investigators and the scope of the search.

What If the State Says the Material Was Shared?

Distribution does not necessarily mean that someone personally sent a file directly to another person. New Jersey law also addresses making qualifying material available through the Internet and certain file-sharing programs.

That makes the technical details relevant. Depending on the allegations, a review may consider how the material was stored, whether file-sharing software was involved, what settings were active, and what investigators can establish about the alleged activity.

What to Do If Police Contact You About a CSAM Investigation

It is understandable to want to explain what happened when detectives contact you. You can ask whether you are free to leave or end the conversation and ask to speak with an attorney before answering substantive questions.

Do not guess at answers or volunteer explanations you have not had time to consider. If officers arrive with a warrant, do not physically interfere with the search. Take note of what happens and contact an attorney as soon as you can.

Most importantly, do not alter or destroy potential evidence. If you are unsure what to do with a device or account, ask your attorney before taking action.
