What Speeding Points Cost You in New Jersey

Under N.J.S.A. 39:4-98, New Jersey assigns points based on how far over the speed limit a driver was traveling: 1 to 14 mph over carries 2 points; 15 to 29 mph over carries 4 points; and 30 mph or more over carries 5 points. These thresholds are fixed by statute and apply to every ticket issued in Hamilton Township the same as anywhere else in the state.

For the most serious speeding offenses, a judge may impose a license suspension or, in rare cases, a jail sentence. Reckless driving, which can encompass excessive speeding, carries 5 points and can result in a court-imposed suspension on its own.

Driving while suspended and driving without insurance both carry mandatory suspension periods when adjudicated in municipal court. These consequences compound quickly for drivers who already carry points on their record.

Hamilton Township Municipal Court handles the full range of moving violations issued on township roadways: speeding, reckless driving, careless driving, driving while suspended, driving without insurance, and other motor vehicle offenses. Technical Defenses in New Jersey Speeding Cases

Speed-detection equipment, including radar and LIDAR devices, must be properly maintained, calibrated, and certified. Records of calibration and operator certification are discoverable in municipal court, and gaps in those records can undermine the reliability of a speed reading. LIDAR evidence may also face admissibility challenges when gathered in adverse weather or at distances beyond 1,000 feet.

The posted speed limit itself is subject to challenge. A speed limit sign that wasn’t properly approved by the New Jersey Department of Transportation through a Resolution or Ordinance may not support a valid conviction. Errors on the ticket, such as an incorrect vehicle description, a wrong statute citation, or a missing officer signature, can provide independent grounds for dismissal or reduction. If the officer used their own vehicle’s speedometer rather than dedicated speed-detection equipment, that measurement is subject to the same calibration requirements as any radar unit.

When the facts of the stop don’t support outright dismissal, negotiating a plea to a non-moving violation eliminates MVC points entirely, preventing both insurance rate increases and MVC surcharges. That outcome isn’t guaranteed in every case, but it’s a path we evaluate for every client before a court date.
