Penalties for Driving While Suspended in New Jersey
New Jersey’s driving while suspended statute, N.J.S.A. 39:3-40, sets out a tiered penalty structure that escalates with each offense. A first offense carries a $500 fine and up to six months of additional license suspension. A second offense raises the fine to $750, adds another suspension period of up to six months, and imposes a mandatory jail term of one to five days. If the second offense falls within five years of the first, the MVC may also revoke the vehicle’s registration. Third and subsequent offenses carry a $1,000 fine and ten days in county jail.
Driving while suspended doesn’t add MVC points to your driving record, but it does add insurance points and creates a permanent entry on your driver’s history abstract. MVC surcharges attach on top of any court-imposed fine, and your insurer will see the conviction.
Enhanced Penalties: DWI-Related & No-Insurance Suspensions
When the underlying suspension stems from a DWI conviction or a breathalyzer test refusal, the stakes rise sharply. Enhanced penalties under N.J.S.A. 39:3-40 include an additional $500 fine, a mandatory suspension of one to two years, and mandatory jail of ten to ninety days. Driving while suspended during a DWI-related suspension tied to a second or subsequent DWI offense can be charged as a fourth-degree crime, carrying a mandatory 180-day term of imprisonment without parole eligibility.
When the suspension arises from a no-insurance conviction, the court must impose a further suspension of one to two years and may add up to ninety days in county jail. If driving while suspended results in an accident that causes personal injury to another person, a mandatory minimum of 45 days in jail applies regardless of fault.
Driving Record Points in New Jersey
Accumulating 12 or more points on your New Jersey driving record triggers an automatic license suspension by the MVC. Points are assessed for both major and minor moving violations, with major offenses carrying heavier point values. Parking tickets don’t add points, but most moving violations do.
Points don’t stay on your record permanently. Three points are removed for every 12-month period in which you don’t receive new points, and completing a qualifying driver improvement course can also reduce your total. It’s also worth noting that MVC points and insurance points are separate systems. A DWI conviction, for example, adds nine insurance points to your record even though it adds zero MVC points.
Driving Without a License Under N.J.S.A. 39:3-10
Operating a vehicle on a public highway in New Jersey without a valid driver’s license or validated permit is a traffic violation under N.J.S.A. 39:3-10. The statute carries one exception: a driver under supervision during a behind-the-wheel driving course is not in violation.
Penalties Under N.J.S.A. 39:3-10
Penalties depend on whether the driver previously held a license. For drivers who once held a license but had it revoked, the statute allows up to 60 days in county jail, a fine of up to $500, and an annual surcharge of $100 for three years. Drivers who have never held a license face a fine of at least $200 and are barred from applying for a license for a minimum of 180 days from their eligibility date.

Each situation carries its own defense possibilities. A driver in the “previously licensed” category who relocated from another state may have been unaware that an issue with their former-state license was blocking a valid NJ license transfer. If the impediment was unknown or mistaken, that fact can be a viable line of defense. For someone who has never held a license, showing they were under appropriate supervision in a behind-the-wheel training course at the time of the stop is a recognized defense under the statute.
There is also a procedural consideration that applies to both categories: to sustain a driving while suspended charge, the prosecution must produce MVC suspension papers and proof of mailing. When that documentation has gaps or can’t be produced, it creates grounds to seek a reduction to the lesser unlicensed driver offense under N.J.S.A. 39:3-10, which avoids additional suspension and insurance surcharges.
Driving Without Insurance in New Jersey
N.J.S.A. 39:6B requires every registered vehicle operating principally in New Jersey to carry liability insurance covering death, personal injury, and property damage. Driving without that coverage is one of the most serious traffic offenses in the state.
A first offense carries a mandatory one-year license suspension, a $300 to $1,000 fine, and community service. Second and subsequent offenses escalate to a jail term of 14 days or more, a two-year license suspension, a fine of up to $5,000, and at least 30 days of community service. After a repeat offense, the driver must apply to the Director of the Motor Vehicle Commission to regain the right to drive, and the Director may deny the application entirely.
A no-insurance conviction also triggers a surcharge of $250 per year for three years ($750 total) and adds insurance points to the record, raising premiums on top of every other penalty. The same statute covers a registered owner who permits another person to drive the vehicle without insurance, provided the prosecution can show the owner knew or should have known the vehicle was uninsured.
